Terms of Service

These Terms of Service (“Terms”) form a legally binding contract between you (“you”, “Your business”) and VoxQuote (“we”, “us”) governing your access to and use of the VoxQuote web and mobile application (the “Service”). By creating an account or using the Service you accept these Terms.

1. Who we are

VoxQuote is operated in Australia. If we are required to provide a registered business name and ABN, we will do so on request. Contact: support@voxquote.com.au.

3. Your customers & content

You retain all intellectual property rights in the quotes, customer details, transcripts and photos you upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, display, and adapt Your Content solely to operate and improve the Service for you.

You confirm you have the right to collect and share your customers' details with us for the purposes of the Service, and that you will comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in relation to those details.

4. Voice transcription & AI extraction

The Service transcribes audio you record and uses AI to extract structured quote details. We do not guarantee that transcription or extraction is 100% accurate and you are responsible for reviewing every draft before sending it to your customer. We are not liable for errors, omissions, or misquotes arising from AI output that you accept and send.

6. Quotes you issue to your customers

Quotes you generate are contracts between you and your customer. We are not a party to those contracts. When your customer accepts a quote through the Service and signs by typing their name, they are entering into a contract with you on the terms of that quote. You remain solely responsible for performing the work, invoicing, GST compliance, and any warranties.

7. Payments (Stripe)

Where you generate a Stripe payment link for a customer, funds flow through Stripe under Stripe's terms. Disputes, refunds and chargebacks are between you, your customer, and Stripe.

8. Acceptable use

You must not use the Service to send spam, misleading, defamatory or unlawful content; to impersonate another business; to bypass our rate limits or security; or to violate any Australian or applicable overseas law. See our Acceptable Use Policy for more.

9. Availability & consumer guarantees

We provide the Service on an “as is” and “as available” basis and do not promise the Service will be uninterrupted, error-free, or meet your specific business needs. Nothing in these Terms excludes or limits any non-excludable consumer guarantee you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) — which continues to apply in full.

You may close your account at any time. We may suspend or close your account if you breach these Terms, if required by law, or if the Service is discontinued. On termination we will hold your data for up to 30 days before permanent deletion, so you can export it.

12. Tax invoice & GST compliance

If you are registered for GST, quotes and tax invoices you generate through the Service must comply with the A New Tax System (Goods and Services Tax) Act 1999 and ATO tax-invoice requirements (supplier's identity and ABN, date, description, GST amount, and — for supplies over $1,000 — the recipient's identity). The Service provides a template; you are responsible for the accuracy of ABN, GST treatment, and any withholding.

We intend these Terms to be fair. If any term is found to be unfair under the Unfair Contract Terms regime in the Australian Consumer Lawand the ASIC Act 2001, that term is void to the extent of the unfairness and the rest of these Terms remain in force.

Neither party is liable for failure to perform because of events beyond reasonable control — natural disaster, fire, telecoms outage, cyber incident, government action, AI-provider outage, or similar.

17. Assignment

You cannot assign these Terms without our written consent. We may assign these Terms (e.g. on a sale of the business) on notice to you.

18. Severability & entire agreement

If any term is unenforceable, the rest stay in force. These Terms, the Privacy Policy and the Acceptable Use Policy are the entire agreement between you and us on the subject matter.

19. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of NSW have non-exclusive jurisdiction — you may also bring proceedings in your home state.

20. Changes

We may update these Terms. If we make material changes we will notify you by email and show a notice in-app at least 14 days before they take effect.
